Ben is an experienced litigator, strategic advisor and non-executive director with a strong bias for efficient and effective problem-solving, clarity of analysis, flexibility of thought and a focus on results. The majority of Ben’s work now touches on equine, financial services or pharmaceutical/medical device sectors, although by no means exclusively.

Ben’s practice brings to bear his wider commercial experience; in addition to his private practice background, Ben has served as General Counsel to a US based fintech business, has held executive roles (including regulatory and commercial turnaround roles) in pharmaceutical and medical-device businesses and continues to act as a non-executive director to a £300m revenue privately held business in the pharmacy sector, in addition to other board roles.

Recent Work

  • Successfully defended a £1.5bn, 100+ defendant claim on behalf of a US-based fintech company. The claim was dismissed on a preliminary issue (the Revenue Rule), with an order for indemnity costs exceeding £2m. This avoided a 12-month trial, which would have been one of the largest and most complex cases heard in the Commercial Court. The case was subsequently settled on confidential terms on appeal.

  • (As General Counsel) Led a complex transaction resulting in the sale of the business of a US-based cross-border finance, securities processing, and international tax relief company to Euronext N.V.

  • Managed a £10m claim and cross-claim relating to an abortive transaction in the pharmaceutical/licit narcotics industry, involving allegations of fraud against the CEO of a listed acquiring party. Settled on confidential terms.

  • Obtained summary judgment in a claim for dishonest assistance concerning QROPS fraud. Secured orders for the payment of substantial damages, along with compound interest.

  • Achieved a £4m settlement in a claim against a leading firm of solicitors for negligent advice concerning FCA authorisation, resolved on confidential terms.

  • Resolved a £2m dispute over the suspicious loss of an elite dressage horse, settled on confidential terms.

  • Acted in a high-value dispute in the music industry concerning breach of management and recording contracts, involving high-profile individuals.

  • Secured a £1m+ net payment in a damages settlement for a client who had been sued for £1.5m in payments on account that they admitted receiving but had not provided the related services.

  • Successfully defended a technical personal guarantee claim at trial.

  • Won contested FCA authorisation proceedings before the RDC committee, preventing business closure and saving 50+ jobs.

  • Favourably resolved numerous high-value shareholder disputes, including petitions for unfair prejudice, just and equitable winding-up petitions, and other "commercial divorce" scenarios.

  • Led a £1m professional negligence claim against a leading provider of online security services for breach of contract and professional negligence, resolved through mediation.

  • Successfully defended a multi-party agency law claim at trial relating to the purchase of a thoroughbred racehorse at auction from a prominent bloodstock auctioneer.

  • Settled a £0.5m niche professional negligence claim against providers of pharmacovigilance regulatory consultancy on confidential terms.
